Its existence is characterized by a unique feature, as it not only performs the functions of a religious court but also has jurisdiction over Islamic criminal law (jinayah). This study aims to analyze the constitutional legitimacy of the Sharia Court, its institutional design within the national judicial system, and the potential for structural disharmony that may arise in its implementation. This research employs a normative legal method with statutory and conceptual approaches. The findings show that the Sharia Court has strong constitutional legitimacy based on the 1945 Constitution of the Republic of Indonesia, further reinforced by Law Number 11 of 2006 concerning the Governance of Aceh, thereby confirming its lawful existence within the national judicial system under the Supreme Court of the Republic of Indonesia. In terms of institutional design, the Sharia Court reflects an asymmetric judicial structure, meaning it operates within the same national judicial framework but with broader jurisdiction compared to general religious courts. This design represents a model of controlled legal pluralism, in which Islamic law is integrated into the state legal system in a regulated manner. However, the study also finds potential structural disharmony, particularly regarding normative differences between national law and Islamic criminal law, as well as coordination among law enforcement institutions. Nevertheless, these potential issues can be minimized through regulatory harmonization and strengthened institutional coordination. Thus, the Sharia Court functions not only as a judicial institution but also as a constitutional instrument in managing legal pluralism in Indonesia within the framework of a rule-of-law state.

2026-06-07T00:00:00+01:00 Copyright (c) 2026 Kasmayanti, Zakiul Fuady https://journal.yibri.id/index.php/brijief/article/view/195 Islamic Accounting Literacy and Business Sustainability: Evidence from Indonesian MSMEs 2026-07-27T04:58:56+01:00 Khairil Anshari Khairilansari2107@gmail.com Riana Sitio sitior49@gmail.com Yurmaini Yurmainiyus86@gmail.com
Micro, Small, and Medium Enterprises (MSMEs) play a vital role in Indonesia's economy, yet business sustainability remains a significant challenge, particularly in relation to financial management capabilities. One competency expected to enhance business sustainability is Islamic accounting literacy. This study aims to analyze the level of Islamic accounting literacy, examine the level of business sustainability, and investigate the effect of Islamic accounting literacy on the business sustainability of MSMEs within the Insan Kreasi Indonesia Community. The study employed a quantitative explanatory research design. Primary data were collected through questionnaires distributed to MSME owners selected using purposive sampling. Data were analyzed using descriptive statistics, coefficient of determination, and simple linear regression with IBM SPSS Statistics. The findings indicate that both Islamic accounting literacy and business sustainability are at high levels. Regression analysis reveals that Islamic accounting literacy has a positive and significant effect on business sustainability (β = 0.241; p = 0.017), explaining 16.1% of the variance in business sustainability (R² = 0.161). The study concludes that strengthening Islamic accounting literacy improves financial governance and contributes to the long-term sustainability of MSMEs. Therefore, continuous training and mentoring programs in Islamic accounting literacy are recommended to enhance sustainable business performance.
2026-06-07T00:00:00+01:00 Copyright (c) 2026 Khairil Anshari, Riana Sitio, Yurmaini https://journal.yibri.id/index.php/brijief/article/view/181 Strategi Penyaluran Dana Pada Bank Syariah 2026-06-02T11:54:33+01:00 Rafly Bagus Prasetia raflybagus222@gmail.com Andrean Putra Harianto andreanputra160106@gmail.com Najma Azzahra Putri putrinazma368@gmail.com Siti Patimah sitipatimah6443@gmail.com Ahmad Hazaz Syarif hazassyarif@radenintan.ac.id
This research aims to examine the fund distribution strategy in Islamic banking, which includes the concept of fund distribution, types of financing, financing feasibility analysis, portfolio diversification, financing risk, and expansion strategy. Islamic banks act as financial intermediaries that channel public funds through various Sharia-compliant contracts such as murabahah, mudharabah, musyarakah, ijarah, and istishna, all based on Islamic principles. The method used is a descriptive qualitative approach with a library research technique, analyzing various scientific journals and literature from the last five years. The focus of the study is directed at evaluating the effectiveness of fund distribution strategies in supporting optimal financing while maintaining the financial stability of Islamic banks. The results show that Islamic bank financing distribution plays an important role in encouraging the growth of MSMEs (Micro, Small, and Medium Enterprises) and strengthening the Sharia-based economy. However, several challenges still exist, such as non-performing financing (NPF) risk, low Islamic financial literacy, and limited innovation in financing products. Therefore, the application of financing feasibility analysis based on the 5C+1S principle, portfolio diversification, and effective risk management are key factors in maintaining financing quality. In addition, expansion strategies through optimizing Third Party Funds (TPF), digitalization of services, and increasing productive sector financing also play an important role in expanding the market share of Islamic banks. In conclusion, the success of fund distribution strategies in Islamic banking is highly dependent on the synergy between risk management, financing diversification, and well-directed expansion strategies. Proper implementation of these strategies not only enhances financial stability but also strengthens competitiveness and supports the sustainability of the Islamic banking industry in Indonesia.
2026-06-07T00:00:00+01:00 Copyright (c) 2026 Rafly Bagus Prasetia, Andrean Putra Harianto, Najma Azzahra Putri, Siti Patimah, Ahmad Hazaz Syarif https://journal.yibri.id/index.php/brijief/article/view/182 Green Financing Dalam Perbankan Syariah 2026-06-05T03:05:55+01:00 Ellen Marfuah ellenmarfuah@gmail.com Neysa Aprilia Putri neysaaprillia87@gmail.com Shofia Puspita Sari shofiapuspitasari@gmail.com Roby Apriadi Saputra robyapriadis@gmail.com
This study discusses green financing in Islamic banking as an effort to support sustainable development and environmental preservation. Indonesian Islamic banking has a comprehensive regulatory framework; however, a fundamental question remains: does the regulation genuinely represent maqashid sharia values, or is it merely an adaptation of the conventional banking system with Islamic terminology? This study employs a juridical-normative approach with content analysis method applied to Law No. 21 of 2008 on Islamic Banking, Bank Indonesia regulations, and the Financial Services Authority (OJK) regulations. The theoretical framework used is contemporary maqashid sharia theory, particularly Jasser Auda's systems approach model. The findings reveal that formally, Indonesian Islamic banking legislation reflects several maqashid principles, especially the protection of property (hifz al-mal). However, substantively, there remain significant gaps in implementing the protection of life (hifz al-nafs), intellect (hifz al-aql), progeny (hifz al-nasl), and religion (hifz al-din). This study recommends a more holistic legislative reform that places maqashid sharia as the spirit, not merely a regulatory ornament.
2026-06-07T00:00:00+01:00 Copyright (c) 2026 Ali Idris, Zakiul Fuady https://journal.yibri.id/index.php/brijief/article/view/175 Integrasi Zakat Dalam Sistem Fiskal Nasional Analisis Konstitusional dan Implementatif 2026-05-02T15:24:10+01:00 Ihwatun Hasanah ihwatunh@gmail.com Zakiul Fuady zakiulfuadymds@gmail.com
Employing normative legal methods through juridical-empirical, historical, and analogical approaches, the research finds that the direction of legislation from 1998 to 2026 is selective-accommodative. Expansion occurred in the areas of Islamic economics and Acehnese autonomy, while the formalization of national criminal law experienced decline. Four integration models are identified: formalistic, transformative, hybrid, and sectoral. The ambiguity of the grand design has led to regulatory fragmentation and normative inconsistency. This study proposes an integrative harmonization model based on maqashid al-shariah and human rights, supported by five pillars: maqashid as a framework, human rights as a minimum standard, pluralism of Islamic legal methodologies, subsidiarity, and inclusive public participation.
